The process behind confirming a Supreme Court nominee is simple. Hearings are held in the Senate Judiciary committee and the 11 Republicans and 9 Democrats on the committee decide whether the nominee is good enough to be put to a full floor vote.
From there, the nominee moves to the Senate floor and the Senate rules require a supermajority in order for him or her to be confirmed.
Right now, the only two people that are standing in the way of Obama putting another liberal on the Supreme Court are Senate Judiciary Chairman Chuck Grassley and Senate Majority Leader Mitch McConnell. They alone can decide whether to start the confirmation process.
At the moment, Grassley has said he will not risk putting Merrick Garland up for a committee vote because then it would only take 2 Republicans to vote alongside the Democrats in order to move it forward. Once a nomination clears the Judiciary committee, it is up to the Majority Leader to schedule a floor vote.
Right now, these two men aren’t budging. This is hardly reassuring given the fact that they have both caved on Obama appointments more often that I can count.
But Democrats have found a way around this blockade and are moving to force a vote on Obama’s nominee!
It takes, at a minimum, 16 Republicans to switch sides and vote with the Democrats in order to confirm a Supreme Court nominee. The votes are there. There are more than enough GOP turncoats eager to surrender the Supreme Court to the leftists.
That is why we have been pushing so hard to stop a vote from even happening. There are simply too many RINOs to trust that the GOP will hold firm on this, so vote is being blocked all together.
But Harry Reid and the Democrats have found a way around this. They are planning to use a “motion to discharge” to force a vote on Merrick Garland. Like the “discharge petitions” in the House of Representatives, Motions to Discharge are rarely-used parliamentary maneuvers in which the minority can circumvent majority roadblocks and the committee process entirely to force a floor vote.
Sen. Grassley, the man who is supposed to be leading the charge to stop Obama’s nominee, admitted that there’s nothing to Republicans can do to stop the Democrats. “I don’t think that there’s any way Republicans can keep from having a vote sometime between now and the election,” Grassley admitted, if [Republicans] think they’re going to avoid this issue entirely, under the rules of the Senate, it isn’t possible because of various motions that can be made.”
GOP leadership is openly admitting that they won’t even try to stop the Democrats from forcing a vote. They’re so confident that you’re not paying attention that they are publicly explaining to the Democrats how to go around their roadblocks. The arrogance is astounding.
This confirms what we have been saying along. The Republicans don’t really care about whether Obama gets his Supreme Court appointment. They only care that the voters seeing them fight against it. They did this on Obamacare, on the budget, on illegal immigration, on gun control, the list goes on and on…
They do this all the time. They promise to fight against a policy or piece of legislation and then quietly allow it to pass through some convoluted parliamentary maneuver.
The GOP Establishment is counting on you to be too preoccupied or uninformed to notice or care that they are surrendering. They’re counting on you to pay no attention to the fact that they are doing exactly the opposite of what they’re claiming to do.
But here’s what they don’t expect: you. They don’t expect you to fight back. They don’t expect you to pay attention to parliamentary maneuvering. They don’t expect you to call them out on their lies. They certainly don’t expect you to make this a primary issue.
That is why it is so important for you to get loud and hold Congress accountable! Now that you know what is going on, you have an obligation to fight against it.
They think they can get away with this and it is up to YOU to put the fear of God into them!
