While the media is going on about whether Melania Trump plagiarized Michelle Obama’s speech – she didn’t – they are quietly ignoring the fact that Barack Obama just re-filed the illegal alien amnesty case and asked the Supreme Court to hear it again.
This is the question over whether the President has the authority to rewrite immigration law to bestow benefits and work permits to people in the country illegally. The question is whether the President can ignore his oath of office and Constitutional duty to ‘faithfully execute the law’ by refusing to deport millions of illegal aliens.
Because of the late-Justice Scalia’s empty seat on the bench, the Supreme Court issued a 4-4 ruling last month on the case, meaning that the Appeals Court ruling against the administration stands.
Now, Obama is asking for the Court to hear the case again. At first, I was absolutely puzzled over this. It makes no sense to ask the Court to re-examine the case if the make-up of the bench is unchanged and then I realized… The United States Senate is in recess.
Because the Senate officially left for recess, the President of the United States now has the constitutional power to make recess appointments to vacant executive and judicial postings that would otherwise require Senate confirmation.
By formally asking the Supreme Court to re-hear the case, now all he has to do is make a recess appointment to fill Scalia's seat and he will have a majority on the Court to rule in his favor!
Recently, the Republicans have chosen not to go into recess and instead opted to keep at least one Senator in Washington DC over the Congressional vacation period.
This is a technicality used to stop Obama from making recess appointments. As long as someone is in the chambers, then Congress can remain in session.
But last week, both the House and the Senate formally went into recess.
That means that right now, Obama could put his radical Supreme Court nominee onto the bench and Congress would be powerless to stop him.
He is already laying the groundwork. By petitioning the court to rehear the case, he now can fill the vacancy to allow the court to rule on his petition.
This is what happens when GOP leaders like Ryan and McConnell say they’re going to leave it up to the courts to decide. They could have defunded this amnesty program but they chose not to.
Now we are left facing the prospect of Obama pushing this through anyway.
We have to act fast. At any moment, a recess appointment could be made. If that happens, it will be too late. The damage will be irreversible.
Once Obama opens the floodgates for legalizing illegal aliens, it will be game over.
