Both Barack Obama and Joe Biden have adamantly denied having any involvement in the scheme to lock up Gen. Michael Flynn. Just minutes before Trump arrived in the White House, Susan Rice even sent herself a cover-your-behind email swearing up and down that Obama and Biden went out of their way to tell the FBI to investigate Flynn "by the book."
That was a lie. They were the ones who ordered the FBI to launch the witch hunt in the first place.
We know from Sally Yates' testimony that Obama and Biden knew about Michael Flynn's phone calls before she even did (and she was the #2 highest ranking official in the Justice Department). We also knew from her now-declassified testimony that it was the Obama administration that originally suggested investigating Michael Flynn for "Logan Act" violations.
The Logan Act was passed in 1799. The law makes it a Federal crime for a civilian to negotiate with a foreign government official on America's behalf. This law has never been successfully prosecuted because it is flagrantly unconstitutional. It is a violation of the 1st Amendment to criminalize free speech.
We knew that someone in the Obama administration had recommended that the FBI/DOJ use this unconstitutional law as the pretext for investigating Flynn, but we didn't know who. Yates had said it was Comey, but Comey denied it and said it was someone else in the room.
Now we know it was Joe Biden...
Yesterday, the DOJ was forced to release newly discovered hand written notes. The notes were written by Peter Strzok, the FBI agent that literally launched the witch hunt against Trump.
The hand written notes detail the meeting at the White House when Flynn was discussed. Except, Strzok wasn't in that meeting. Strzok took the note as James Comey was telling him what was said in the meeting. Here is how James Comey described the discussion:
Comey+Yates: lean forward on unclass?
Biden: “Logan Act”
Obama: These are unusual times
Biden: I’ve been on the intel cmte for ten years and I never...
Obama: Make sure you look at things + have the right people on it
Obama: Is there anything I shouldn’t be telling transition team?
Comey: Flynn –> Kislyak calls but appear legit
Obviously, these are Strzok's handwritten notes as the discussion is being retold to him, but they provide the best view into what went on in this secret White House meeting.
We knew that the meeting was to discuss investigating the incoming Trump administration. We knew that the meeting was damaging enough that Obama officials tried to cover it up by saying it was all "by the book." And we knew that the DOJ was caught off guard by the White House knowing more about Flynn's calls than they did.
But now we know that it was Joe Biden who told the FBI to pursue a Logan Act investigation and it was Barack Obama himself who ordered the FBI to look into it.
Just so we are clear, the charges against Flynn were ordered to be dropped yesterday. It was proven that the DOJ's case against Flynn was a complete sham. Not only that, but they deliberately hid evidence that would have helped prove Flynn's innocence, like the note we just talked about above.
What Barack Obama and Joe Biden did was criminal. Colloquially, this is known as abuse of power. Siccing the FBI and DOJ on an incoming administration is as abusive as it gets.
But this is formally known as "Deprivation of Rights Under Color of Law." Found in 18 USC Section 242, it makes it a Federal crime for anyone in government to abuse their power to violate someone's rights.
We already know that Michael Flynn's rights were violated. This man had his life turned upside down for no reason whatsoever. He lost his life savings, had to mortgage his home, and almost went to prison for a crime he didn't commit, all because the FBI threatened to go after his son if he didn't.
The DOJ hid exculpatory evidence from him, struck backroom deals with his old legal team, and illegally pressured him into pleading guilty. The only question left is who is guilty of this crime...
In most cases, we would go right after the agents running the investigations. But in this instance, we now know that this went all the way to the top, implicating Obama and Biden themselves... A crime was committed and their fingerprints were found at the scene...
We knew that both Obama and Biden had ordered for Michael Flynn's phone calls to be unmasked. They were the Obama administration officials who were spying on the Trump transition team. Now we know why...
Biden told the FBI to investigate Flynn using the bogus Logan Act as a pretext for the witch hunt. Obama then gave the FBI and DOJ orders to launch the investigation and a sinister instruction to "make sure the right people were on it." Comey then obeyed that order and handed the investigation over to the most anti-Trump agents in the Bureau...
These people need to pay for what they did. They must be forced to answer for their crimes!
