Our justice system is based on a very simple principle: Americans are innocent until the government proves, beyond a reasonable doubt, that they are guilty.
The same is true when you go to buy a firearm. You submit to a background check and unless the FBI can articulate a legal reason to deny you, then you must be allowed to purchase the gun.
Right now, there is a deadline for the FBI to process a background check: 72 hours. If the FBI cannot give a yes or no answer to a background check after three days, then the law allows the purchaser to take the gun home anyway.
This is crucial because without this 72-hour deadline, the government could simply block gun purchases by refusing to conduct the background checks.
Well, Democrats are now holding a vote THIS WEEK on a bill to undo this safeguard. They are forcing a vote on H.R. 1446 to give the government the power to indefinitely block gun purchases for no reason at all!
This package would give the government the power to suspend the 2nd Amendment. And the idiot Republicans are talking about this bill as if it's a compromise...
Practically all of the gun background checks are completed within an hour, but the 72-hour timeframe gives the FBI time to double check any red flags that come up. If the FBI can't complete the instant background check after three days, then the gun owner is allowed to take the firearm home anyway.
This was an important compromise when the current background check law passed in 1994. Without it, the legislation never would have had enough votes to pass. But now, Democrats want to do away with the compromise entirely.
The Enhanced Background Checks Act of 2021 (H.R. 1446), however, would change the law to give the FBI ten business days to complete an "instant" background check. If you want to appeal a rejection, then the FBI would have another ten business days to process the appeal. Combined, that is an entire month. This is by design. An ATF 4473 background check form is only valid for one month.
If you don't pick up a firearm within a month of filling out the background check paperwork, you have to do it all over again. This is to make sure that you haven't committed a crime in the meantime.
What H.R. 1446 does is allow the FBI to indefinitely block gun purchases, without even having to give a reason. They can run out the clock for an entire month, wait for the background check form to expire, and then force you to restart the process all over again.
This is a power the Left has always wanted: the ability to simply block Americans from buying guns. By design, H.R. 1446 only applies to gun stores. But Democrats are also forcing a vote on H.R. 8, their universal background check bill. This would force Americans to undergo a background check whenever they want to privately purchase a firearm.
You guessed it: when combined, H.R. 8 and H.R. 1446 would let the government block pretty much all gun sales, indefinitely, without having to give a legitimate reason...
They must be stopped!
Already, some Republicans are calling this a "compromise," as opposed to a complete confiscation or registration bill. Let me be absolutely clear: there is no "compromising" on this. These two bills are designed to give the Federal government the power to restrict firearm purchases indefinitely, without cause.
Democrats want this power because they plan to use it!
We can still stop these two bills, but as I said, Democrats are forcing a vote on both of them THIS WEEK. The Left is rallying their supporters to try to push it through.
You MUST stand up and stop them!
