Yesterday was a sad day for Conservatism in Congress. Mitch McConnell scheduled two votes in the Senate. One measure was to give President Trump the border wall funding, and the other plan would have re-opened the Federal government without spending even a cent on border security.
Neither were expected to get the 60 votes necessary to pass, but then, something shocking happened. Six Senate Republicans joined Democrats and voted to cave and re-open the government without securing the border!
They are: Senators Lamar Alexander (TN), Susan Collins (ME), Cory Gardner (CO), Johnny Isakson (GA), Lisa Murkowski (AK), and Mitt Romney (UT).
We knew that a handful of GOPers had decided to cave, but even our count didn't reveal this many turncoats.
Just to be clear: they voted to appropriate the border wall funding. But they also voted to give up the fight and force Trump to accept defeat on the border wall.
Republicans supposedly control a majority in the Senate, but when the dust settled yesterday, it was the Left's bill to block the wall funding that ended up having the most votes!
President Trump has had enough. The White House is now moving forward with drafting an executive order declaring an immigration emergency at the border. This would immediately give Trump access to tens of billions in discretionary funding. He plans to use seven billion to get started on the wall.
Both the law and the Constitution are firmly on the President's side. The National Emergencies Act of 1976 allows the President to declare a national emergency and use discretionary funding to address it. Right now, there are 32 active 'national emergencies' that were declared by previous Presidents.
Title 10 of the United States Code, Section 2808 says that,
"In the event of a declaration of war or the declaration by the President of a national emergency... the Secretary of Defense, without regard to any other provision of law, may undertake military construction projects, and may authorize the Secretaries of the military departments to undertake military construction projects, not otherwise authorized by law that are necessary to support such use of the armed forces."
That right there is Trump's ticket to build the border wall and the GOP wants to block him!
When the news broke last night that the White House was preparing the order, the GOP leadership immediately reached out to Trump and told him 'don't you dare.' You see, McConnell thinks they are close to a deal with the Democrats and threatened to block Trump's order if he went through with it.
Why is the GOP so angry? They are telling the truth. They are closer to a deal now than they were last week... but it is because GOP cowards are jumping ship and voting to give up on the border wall fight!
We finally have a President willing to fight to secure the border and the GOP just can't surrender fast enough.
President Trump is doing everything he can, but he needs your help to force Congress to fall in line!
Amazingly, as Republican cowards have started jumping ship, moderate Democrats have also been fleeing from Pelosi's hardline. Even the House Majority Leader, Steny Hoyer (D-MD), admitted that he'd be ok with funding the border wall. No less than a dozen Democrats have come out and demanded that the Democrat Leadership compromise and let Trump build the wall.
Pelosi isn't budging. She is counting on Republicans caving first.
This morning, LaGuardia Airport began cancelling airline flights because air traffic controllers started not showing up to work. The pressure is starting to really mount on Congress to end the shutdown.
We are SO close to winning this fight. But after yesterday's vote results, we also know that it only takes a couple more GOP defections to lose it all!
Sincerely,
Joe Otto
