Activist liberal judges are truly ruining this country.
On Friday, the 9th Circuit Court of Appeals gave Trump a "partial win" in his fight to stop the surge of illegal aliens committing asylum fraud at the border. The media presented it as a win for the President, but it isn't that simple... But first, a little background information.
Earlier this summer, President Trump issued an executive order requiring that all asylum seekers wait in Mexico while their cases make their way through the court systems. Illegal aliens have been flooding the courts with fraudulent asylum applications for years. They know that it takes 2 years for a case to make it before a judge, so if they apply, the government will have to release them before their court date.
Trump is trying to end this by requiring that all asylum seekers wait in Mexico until their cases are heard. However, Federal District Judge Jon Tigar -- an Obama appointee -- issued a ruling in late July to block the President from doing this. He claimed that Trump was violating these illegal aliens' rights.
But before that Judge's order went into effect, the Trump administration was able to process 1,152 asylum applications in the program. Want to guess how many qualified for asylum? ZERO. Not a single application qualified for asylum. They were all fraudulent.
Under Obama-era rules, these illegals would have been released into the United States and never seen again. But thanks to Trump, these caravan migrants are now returning to their home countries.
The President appealed the ridiculous ruling to the 9th Circuit Court of Appeals. Last week, a three-judge panel -- including one of Trump's appointees -- determined that Jon Tigar had no right to issue a nationwide injunction. Instead, the panel limited the injunction to just states within the 9th Circuit -- namely, California and Arizona.
What does that mean? Well, President Trump's Remain in Mexico program can continue at border checkpoints in Texas and New Mexico. But if an illegal alien shows up at the border in California or Arizona and claims asylum, then Trump would have to let them in. Of course, we are already seeing the migrant caravans starting to re-route to California instead of Texas.
This is absolutely insane.
Luckily, there is a way to stop this. It is called the Secure and Protect Act!
The bill, written by Lindsey Graham, would codify President Trump's program into law. It would require all migrants to apply for asylum as soon as they reach a safe country. In other words, if a migrant has to march through a half dozen countries before reaching the US-Mexico border, then the Secure and Protect Act would require them to apply for asylum in all six of those countries, and be denied, before they would be eligible to apply in the US.
If these people truly are "fleeing for their lives," which is what our asylum laws require, then they should have to apply in the first safe country they reach.
But the bill doesn't stop there. The Secure and Protect Act would also hire 500 new immigration judges to eliminate the 2-year court backlog. Since we know that more than 90% of all catch-and-release Illegal aliens never bother showing up to their court hearings, this provision would stop hundreds of thousands of illegal aliens from being released every year.
The most important provision in the bill would reform the Flores Settlement. You see, the Clinton administration settled a lawsuit back in 1997 and agreed not to detain illegal alien minors or families with children for longer than 20 days. Since it takes over 740 days for an asylum case to reach court, the Flores settlement guarantees that if an illegal alien shows up at the border with a child, he or she will be released and be able to disappear into the country. Even if they are suspected criminals.
The Secure and Protect Act would increase this limit to 100 days. When combined with the new immigration judge hires, this would put an end to catch-and-release once and for all.
Lindsey Graham, for all his faults, kept his promise. He shut down Democrat opposition and pushed this bill through the Judiciary Committee.
But Establishment Democrats and Republicans are refusing to put the bill to a vote. They want more illegal immigration, not less. The Left wants to import new Democrat voters and the GOP wants to give their corporate donors more illegal alien labor.
A radical Obama Judge just broadcast to the entire world that if illegal aliens can reach California or New Mexico, the Federal government has to release them into the country.
We are now racing the clock to shut this down before the next caravans arrive.
Only Congress can stop this madness, and only YOU can force them to!
The United States is the most generous country on earth. But this year, we are on track to see more than a million illegal aliens force their way into the country by committing asylum fraud.
President Trump has the solution and it was working. Illegal aliens were being turned around instead of released into the country. But one Obama judge is standing in the way.
The Secure and Protect Act of 2019 would put a stop to this once and for all. It would crack down on the fraud and close the loopholes, while still respecting the rights of legitimate asylum seekers.
But time is running out before the next caravan border surge!
