Why does Congress even bother writing the laws? Don’t they know that Obama is just going to change them anyway?

Obama has changed the wording of Obamacare AGAIN in order to delay the employer mandate! That means that businesses don’t have to comply with Obamacare until 2016. This is the second time that President Obama has unilaterally rewritten the Employer mandate. Each time he has delayed it for another year. First, Obama pushed back the employer mandate until after the 2014 election. Now, he has done it again and has pushed it all the way back to the 2016 presidential primary season! This law is TOXIC and the Democrats know it. Yet, instead of repealing Obamacare, Obama and the Democrats are trying to hold on just a little longer until after the elections!

You know what Obama has to say about this? He claims he can do whatever he wants!

The President is NOT allowed to change the law! This is unconstitutional and ILLEGAL and Obama must be impeached for this!

The Obama administration has absolutely no respect for the rule of law. The President doesn’t seem to understand that the words written in each law can only be changed by an act of Congress.

You see, the Affordable Care Act is so long and complicated that the Democrats don’t expect anyone to actually read it. If no one reads it, then there is no one to complain when the Democrats unilaterally and illegally alter it.

Well, I have read the Affordable Care Act, and it couldn’t be clearer about when the employer mandate must go into effect.

The employer mandate of the Affordable Care Act requires that any business with more than 50 full-time workers MUST provide its employees with health insurance. The law then stipulates a statutory deadline, ordering that this provision MUST begin in 2014. Here is what is written in the law:

“EFFECTIVE DATE - The amendments made by this section shall apply to months beginning after December 31, 2013.”

This is what is known as a hard-deadline. When laws are written, they take one of two approaches. Either they allow for the executive branch to add regulations stipulating when the law goes into effect, OR they include a hard-deadline written into the law by Congress. The employer mandate includes a statutory hard-deadline and only Congress can legally revise it!

The President knows this. He knows how the legislative process works and he knows that he is violating the Constitution by changing the law. He doesn’t care, though, because he thinks he’ll be able to get away with it!

The President does not have the authority to change the laws as he sees fit. Nowhere in the Constitution does such an executive power exist. The Supreme Court has even weighed in on this issue and has reaffirmed that the President can’t do this.

In Clinton vs. City of New York (1998), the Supreme Court ruled that the President does not have the Constitutional authority to alter a law. Justice John Stevens wrote the majority opinion and clearly explained that “there is no provision in the Constitution that authorizes the President to enact, to amend, or to repeal statutes.” Even if Congress was to pass a law saying that the President could revise statutes… that would still be unconstitutional!

This issue has already been settled in the courts. It is illegal and unconstitutional for the President to amend the Affordable Care Act to delay the employer mandate! Obama’s decision to delay the employer mandate a second time is grounds for impeachment!

It is your responsibility to impeach the President. Only Congress can hold Obama accountable for his flagrant unconstitutional actions, and only YOU can force them to do it!

The Founders didn’t just give you the ability to stop the President… they gave you an obligation to stop him!

It really is pretty cut-and-dry… The Supreme Court has ruled in the past that the President DOES NOT have the authority to alter the wording of a law. If a bill is signed into law, it can only be changed by an act of Congress. There is absolutely no disputing that. But, Barack Hussein Obama did it anyway, arguing that the rules don’t apply to him!

I am tired of watching this President violate the constitution with complete impunity! I am tired of watching Congress and the Supreme Court just sitting back and allowing this to happen!

The United States has never had a President who so openly defies the Constitution and the rule of law! Do you know what Obama told socialist French President Hollande yesterday? Obama told him that as President, “I can do whatever I want!”

No, Mr. President, you can NOT do whatever you want!

Obama is bound by Article II of the Constitution and is supposed to have an obligation to “faithfully execute” the laws. But Obama doesn’t care about the Constitution! He doesn’t honor it and he doesn’t respect it!

No President has the right to change and alter a law as he or she sees fit. It doesn’t matter what political party occupies the White House… this is tyranny and it must be stopped!
