Your colleagues believed that they have reached common ground on a new gun confiscation bill. Instead of passing a massive gun ban, the GOP is offering Democrats a Federal Red Flag passage.

There are a number of ways that the government can revoke someone's Constitutional rights, But they all require prosecutors to actually prove that a gun owner did something wrong. They require prosecutors to prove, beyond a reasonable doubt, that a defendant broke the law. Until then, all Americans are presumed innocent.

But Red Flag laws flip that premise upside down. Prosecutors would be allowed to obtain confiscation orders without even needing to charge the gun owner with a crime. Then, instead of the burden falling on prosecutors to prove guilt, it is up to the gun owner to convince a judge that they deserve their guns back. If the judge disagrees, then the confiscation order can be extended up to a year. Again, all without the gun owner even being charged with a crime.

This bill literally gives the government the power to disarm innocent Americans.

If you give the government this power, it will be abused. Innocent Americans will have their rights violated. This is already happening in states that have passed their own red flag laws.

When you arrived in DC, you put your hand on the Bible and swore an oath to uphold the Constitution. That includes the 2nd Amendment.

Americans have a right to keep and bear arms. But this legislation would transform that right into a revocable privilege. Instead of enjoying presumed innocence, gun owners would be forced to prove to a judge that they deserve to be able to own firearms.
