This week, the House Judiciary Committee approved the Extreme Risk Protection Order Act. This legislation is nearly identical to a version being considered in the Senate.

The bill would dismantle the right to keep and bear arms in this country. I say that because this bill allows, and actually encourages, the government to disarm innocent, law-abiding gun owners without even having to charge them with a crime.

Federal law is clear. In order for someone to lose their gun rights, they have to do something wrong and the government has to prove it. That is called due process. In order to secure a confiscation order, the government has to file criminal charges against a suspect and then prove, beyond a reasonable doubt, that they are guilty.

But Red Flag laws reduce the standard of proof needed for confiscation orders. Prosecutors would be able to secure a 30-day confiscation order simply by convincing a judge there is "reasonable cause" to believe a gun owner is dangerous.

And the legislation allows for the confiscation order to become permanent by convincing a judge that someone is dangerous based on the preponderance of evidence. You can't even get a jaywalking conviction in this country using that standard of proof. All that means is that a judge believes it is more likely than not that someone is dangerous.

What ever happened to due process? Defendants in this country are supposed to be presumed innocent until the government proves they are guilty beyond a reasonable doubt.

But this legislation flips that principle upside down. The government would be allowed to suspend and revoke someone's constitutional rights to self-defense without even needing to charge the gun owner with a crime. And instead of enjoying the presumption of innocence, the disarmed gun owner would have to hire a lawyer and go before a judge and prove that he or she is innocent. If the judge disagrees, then the disarmament order can be extended out.

This is flagrantly unconstitutional. If this standard was being applied to any other constitutional right, you would be up in arms against it. But because we are talking about the right to keep and bear arms, this is being presented as a common sense "compromise."

We all support taking guns out of the hands of criminals and the mentally ill, but the government has to prove that disarmament is justified. That means they have to actually accuse a gun owner of breaking the law and prove it in a court of law.

But this bill simply goes too far. If you give the government the power to disarm innocent people like this, that power will be abused and law-abiding gun owners will suffer.

If you pass this bill, gun ownership will cease to be a right. It will become a privilege that can be revoked by the government without prosecutors even needing to accuse a gun owner of breaking the law.

If you sign onto this bill, or do anything to help it pass, you will be removed from office. This is your warning.
