Rep. Chaffetz has officially referred Hillary Clinton's server technician to the DOJ for prosecution.

This is the man who illegally deleted Clinton's server and then refused to testify before the Congressional Committee.

Chaffetz hopes that he can flip Mr. Pagliano and get him to rat on people higher up the chain of command.

GOP Leadership, however, is blocking a full vote on the Contempt of Congress charges. They have the power to charge Pagliano right now and refer the case to the Grand Jury, but are choosing to protect him and the Clintons instead.

My greatest fear was that if Hillary Clinton won the election, she would use her victory to squash the criminal investigations against her and her family. What does it say about us if we allow her defeat to do the same?

It is a dangerous precedent to set. A Congressional oversight investigation should not be influenced by electoral outcomes. Electoral College tallies have no impact on the merits of the investigation.

Mr. Bryan Pagliano was Hillary Clinton's server technician. You and your colleagues delivered to Mr. Pagliano a Congressional subpoena and preservation order instructing him to safeguard all data files. This order is legally enforceable.

After communicating with the Clinton campaign, Mr. Pagliano instead chose to defy the subpoena by wiping Clinton's server clean. He then tried to destroy the evidence by deleting posts on online message boards asking people how to get away with destroying the data.

You and your colleagues then subpoenaed Pagliano to testify in Congress. He completely ignored the subpoena and never showed up.

This is an open and shut Contempt of Congress case.

Politics is irrelevant. The election result has nothing to do with whether or not Bryan Pagliano defied multiple Congressional subpoenas or whether he destroyed protected evidence.

If you allow this man to go free, you are broadcasting to the entire world that a Congressional subpoena isn't worth the paper it's written on.

That would be shameful.
