These liberal judges have once again proven why the 9th Circuit is the most overturned court in the country. The Trump administration will appeal to the Supreme Court. But without Neil Gorsuch on the bench, it will likely end in a 4-4 tie and leave the 9th Circuit's ruling in place.

Democrats are licking their lips. If they can stall Gorsuch's nomination even just a couple of days or weeks, they can block Trump's refugee ban from ever going into effect.

Yesterday, the 9th Circuit Court of Appeals showed why it is the most overturned court in the country.

8 USC 1182(f) gives the President the authority to bar any class of aliens from entry into the United States if he determines they would pose a threat to the country. The 3 Judge panel didn't even address this statute in their ruling.

This ruling sets a dangerous precedent: All someone needs to block a President's national security decision is proof that it harmed them. Not only that, but the ruling insinuates that foreigners outside the United States may have a Constitutional right to enter the country. It's madness.

The Trump administration will no doubt appeal this case. They will request an en banc hearing in the 9th Circuit and if that fails, petition the Supreme Court.

Without Neil Gorsuch on the bench, any Supreme Court case will likely end in a 4-4 tie, thus keeping the 9th Circuit's sham ruling in place.

Democrats know that the Supreme Court goes back into session in March. They know that if they can stall Gorsuch's nomination long enough, they can essentially block Trump's refugee executive order from ever going into effect. Chuck Schumer is already laying the ground work for this delay tactic, saying that Gorsuch refused to answer his questions.

I am writing to you to plead that you use every tool and power at your disposal to expeditiously confirm Judge Neil Gorsuch. Yes, that includes finishing what Harry Reid started and using the nuclear option.

We are up against the clock. Any delay whatsoever could end up keeping this ridiculous 9th Circuit Court ruling in place. That's not to mention all the other high-profile cases that are coming before the Supreme Court this spring...

You must force GOP leadership to use the nuclear option. If you allow the Left to delay, I will have no choice but to treat that the same as you voting to reinstate Barack Obama's refugee programs. Because the result would be identical.
