In 2012, Justice Antonin Scalia sat for an interview and explained his one wish: that he not be replaced by an leftist, activist judge who would proceed to undo everything Scalia had accomplished on the bench.

That is exactly what your colleagues are preparing to do.

Merrick Garland is not a moderate.

At every turn, he has used his position to legislate from the bench.

On the 2nd Amendment, he took a statute that clearly says the government cannot keep a gun owner registry and created an exception out of thin air. He tried desperately to stop the Heller case from getting to the Supreme Court, showing that he doesn't believe Americans have a right to keep and bear arms.

He has ruled against the 1st Amendment’s free speech protections (Wagner v FEC), in favor of terrorists held in Guantanamo Bay (Parhat v Gates), he let a drug trafficker out of prison on a technicality (US v Gaskins), and most ridiculously, he once ruled that if a corporation purchases land and plans to develop it, the government can come in and stop the entire project for its environmental impact (Rancho Viejo, LLC v. Norton).

That last one is possibly the most ridiculous. Garland ruled that because a housing development was being built near an interstate highway and houses could be sold to people in other states, the Commerce Clause allows the government to intervene and block the project because of environmental impact. What was the impact? The housing project would make life inconvenient for a toad.

Scalia pleaded that his only desire was to make sure he wasn't replaced by a leftist. "I would not like to be replaced by someone who immediately sets about undoing what I've tried to do for 25–26 years," he explained.

Merrick Garland would do just that. He would be the deciding vote in overturning all of Scalia's major accomplishments.

You CANNOT allow this man to be confirmed. No, he is not a "moderate" and no, he is not "good enough."

If you vote for this man, or step aside and allow a vote to move forward, you will have lost my vote. I will do everything in my power to get your next primary opponent elected. That's not a threat, it's a promise. The future of the Supreme Court is too important to let you and your colleagues surrender like this!
