Judge William Fletcher, a Clinton appointee, authored the opinion declaring that President Trump's "Remain in Mexico" policy was illegal and ordered the administration to re-adopt Obama's catch and release policy.
The Remain in Mexico program was simple. Whenever an illegal alien arrived at the border and claimed asylum, they would be forced to remain in Mexico until their case could be heard by a judge. For years, illegal aliens have abused our asylum system to force their way into the country. They would take advantage of Obama's catch and release policy and then disappear into the interior. The vast majority of these illegal aliens never even bothered to show up for their hearings.
Trump's policy stipulated that illegal alien asylum seekers could not enter the United States until their asylum application was approved. But the 9th Circuit tossed out the program on Friday.
It took just hours for news to reach the migrants in Mexico. By Friday evening, hundreds of illegal aliens tried to storm the checkpoint in El Paso and force their way into the country. The Trump administration had no choice but to close the checkpoint to stop the invasion...
This is getting out of control.
This is only happening because Democrats cut funding for ICE and Border Patrol this year. Democrats pushed through a spending package that limited funding for ICE and Border Patrol detention facilities, and the GOP barely even put up a fight.
The result was that in the midst of the biggest border surge in a decade, Border Patrol and ICE were forced to release the vast majority of the illegal aliens they captured. At Democrats' insistence, DHS simply does not have the funding to detain them all.
Trump's Remain in Mexico fixed that. Instead of relying on DHS detention funding to house illegal aliens, the program kept the migrants in Mexico until their court dates.
The 9th Circuit's ruling now opens the floodgates once again. When illegal aliens cross the border, Border Patrol and ICE will have no choice but to let most of them free.
The establishments of both parties want open borders. Democrats want to be able to import new voters and Establishment Republicans want to provide their corporate donors with a cheap labor force. We are in this crisis because both parties like it this way...
Trump is appealing the 9th Circuit's ruling, but the effects are already being felt all along the border. Illegal aliens realize that they have an opening and are storming the border to try to get in.
We know what needs to be done. Lindsey Graham introduced a bill last year -- the Secure and Protect Act (S.1494) -- that would fix all of this. It would (1) put an end to catch and release and allow the government to detain illegal aliens until their cases are heard in court (2) get rid of the asylum loopholes that illegal aliens and smugglers have used to game the system (3) strengthen the asylum qualifications to eliminate fraud, and (4) hire at least 500 new immigration judges expedite deportation proceedings.
But this bill has been collecting dust in both the House and the Senate for six months now. Neither party wants to touch it.
And with this 9th Circuit ruling, the invasion at the southern border is starting again...
This shouldn't be controversial. We know what loopholes illegal aliens are taking advantage of to force their way into the country... We know how to stop them.
President Trump is trying to fix this on his own, but the activist judges on the bench just won't let him.
Only Congress can put a stop to this new invasion before it spirals out of control, and only YOU can force them to!
