Last week, the Senate Judiciary Committee held a hearing on so-called "Red Flag" laws. These are statutes that allow police to confiscate someone's firearms without even needing to technically accuse them of a crime. They are also known as "gun violence restraining orders."

Without question, these gun confiscation laws are the biggest threat to our 2nd Amendment rights. 

The law is clear. You have a right to keep and bear arms for self-defense. If the government wants to suspend that right, they need a pretty good reason.

Federal law allows for disarmament if someone is (1) convicted of a felony or violent misdemeanor, (2) adjudicated mentally defective, (3) dishonorably discharged from the military, (4) an illegal alien, (5) a fugitive from justice, (6) a domestic abuser, or (7) a former-US citizen, meaning they gave up their citizenship. The government needs to prove you did something wrong to suspend your rights.

But Red Flag laws lower the evidentiary bar. They only require hearsay to justify disarmament. If an angry family member, friend, neighbor, or even stranger tells police that you pose a danger to yourself or others, that statement alone is enough to get a confiscation order. Just like a regular restraining order, these confiscation orders don't actually require criminal charges for a judge to sign off on them.

It's then up to the disarmed gun owner to prove that they deserve their guns back. If they can't convince the judge that they aren't guilty, then they have to wait a whole year to get their guns back.

This isn't how our country is supposed to work. This isn't "innocent until proven guilty." It's the exact opposite!

So, why is it Republicans who are pushing this gun confiscation bill forward?

Lindsey Graham led the hearing and admitted that after being inundated with calls, emails, letters, and faxblasts, he doesn't believe there is the will in this country for a nationwide gun confiscation bill. Wow, how observant.

Instead, he now wants to pass Federal legislation incentivizing states to pass their own Red Flag bills. 

So, the committee is going to vote on both bills. One to impose a nationwide gun confiscation program and another "compromise" bill to authorize and finance 50 state-level gun confiscation programs.

Who authored this "compromise" gun confiscation bill? Dianne Feinstein. There's no compromise here at all. Just another predictable attempt to destroy the 2nd Amendment. And the GOP is just going along with it...

The first step of any legislative process is to hold an exploratory hearing. That is what the Senate Judiciary Committee did last week. They brought in gun control experts to explain why it is such a good idea to let the government disarm gun owners without any evidence that they did something wrong.

The next step is to vote on specific bills. One is the Extreme Risk Protection Order and Violence Prevention Act (S.7), which would set this up as a nationwide program. The other is Feinstein's Extreme Risk Protection Order Act (S.506), which would let states and localities use Federal funds to disarm citizens without a trial.

One of those two bills will make it through. They are both equally dangerous.
