In an unusual turn of events (well i guess he does lie a lot), President Barrack Hussein Obama is talking out of both sides of his mouth. After appointing ultra liberal Justice Elena Kagan, former Solicitor General in the Obama administration, who clearly has predetermined ideas in favor of Obamacare, he is now adopting what he previously described as the “language of conservatives”, asking in a speech how an “unelected group of people” could overturn a law approved by Congress.
Hmmm. Well to start with, Congress cannot change the constitution, only amend it (with 66% in both House and Senate and 38 states voting for a change). However, Obamacare mandates that everyone have health insurance (you can be fined if you do not!). The government cannot legally force citizens to do commerce, it is unconstitutional. Since that is the case, the Supreme Court is obligated to strike down the mandate in the Obamacare law requiring citizens to buy healthcare insurance as unconstitutional.
“I’m confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress,” (excluding every Republican) Obama said. Unprecedented, what? It is the duty of the Supreme Court to uphold and defend the constitution including ” a law that was passed by a strong majority of a democratically elected Congress,”.
When Obama makes such statements, one has to wonder if he has ever read the Constitution. The Supreme Court is doing its job. The incredible outcome will be if they do not overturn the fascist nature of the Obamacare law that looks awfully like socialism! In addition, Judge Kagan should disqualify herself in the ObamaCare litigation because of her role, as Solicitor General, in preparing its constitutional defense.
Today, many of our elected officials weighed in on Obama’s comments. Senator Orin Hatch, R-Utah, the top Republican on the Senate Finance Committee, called it a “fantasy” to think “every law you like is constitutional and every Supreme Court decision you don’t is ‘activist.'” “Judicial activism or restraint is not measured by which side wins but by whether the Court correctly applied the law,” he said.
Even after having a politically motivated Justice placed on the Supreme Court, the unconstitutional law will likely be struck down. We the people, the majority of us anyway, do not want Obamacare. Keep it up! Keep the pressure on the government to throw out this kluge. We are a free nation; free to speak, free to pray and free to do business!
