Dear Conservative,
The nonpartisan Government Accountability Office (GAO) recently released a damning report, finding that the Obama administration seriously broke the law when it traded 5 high-ranking terrorists in return for Army deserter/terrorist sympathizer Bowe Bergdahl.
The GAO found that without a doubt, the administration broke the law when it transferred those high-ranking Taliban fighters without notifying Congress.
This wasn’t just a suggestion that Congress be notified… it was written into the law. The President MUST, by law, notify Congress whenever the administration plans to transfer high-value prisoners.
Add it to the growing list of Obama’s illegal executive actions…
But the GAO found even more illegalities. Congress, specifically the House of Representatives, has the authority to draft a budget for the Executive Branch. While there is some discretionary spending built in, the law is pretty cut-and-dry over how much money different government agencies/departments can spend on certain activities.
The GAO has determined that the Pentagon illegally siphoned money from other accounts to facilitate the transfer. This is something they CANNOT legally do. This action violated the Antideficiency Act, a law that prohibits government agencies from spending more money than Congress allocates to them.
One of the checks and balances built into the Constitution is that Congress has the power of the purse. This gives it the power to withhold money and essentially control the Executive Branch by limiting its funding.
So not only was the Obama administration’s prisoner transfer illegal, but it was also unconstitutional!
The courts will have to decide what to do with the Obama administration moving forward, but I have one question that has been lingering on my mind:
Why the hell isn’t Bowe Bergdahl behind bars yet?
The Administration is stalling in prosecuting Bergdahl and apparently might let him off the hook all together! This cannot be allowed to happen!
I understand that everyone is innocent until proven guilty… I understand that every American citizen deserves his or her day in court.
No one is denying that… But the Obama administration continues to delay that court date and has yet to file a single charge!
Late last month, the Pentagon announced that it was extending the investigation into Bergdahl’s desertion and treason. Despite a preponderance of evidence proving his guilt, the Military is still not ready to charge this deserter with the crime he committed. The investigation was only supposed to last 60 days, but it has been delayed so many times that we likely won’t learn whether Bergdahl is even charged until after the midterm elections…
How convenient… Whenever the Obama administration has horrible news (Obamacare rate increases, illegal alien amnesty, letting Bowe Bergdahl off the hook…), the standard practice is to wait until after the midterm elections. That way, Obama’s actions can’t be used against Democrats, or at least not in that election cycle…
The fact that the investigation into Bergdahl’s desertion has been delayed until after the midterms proves to me that the administration is going to let this traitor walk!
I mean, think about it…We are hearing of rumors and chatter on Capitol Hill that Bowe Bergdahl will never see the inside of a prison because it would thoroughly embarrass the President!
It has now been almost FOUR whole months since the illegal prisoner exchange brought this dishonorable deserter back to the United States. It has been four months since the Obama administration lied to the American people by painting Bergdahl as an honorable and distinguished war hero.
The facts are all there. He deserted his unit during a time of war; he deliberately sought out the Taliban, and eventually began to live with them in complete harmony. He wasn’t a captive. The evidence shows that he was their ally.
His fellow soldiers have reported that once Bergdahl went missing, the IEDs aimed at American convoys in the region suddenly became more complex and deadly. But the Obama administration wants us to believe that is a coincidence…
This case couldn’t get clearer. Bergdahl deserted his unit during a time of war to seek out the enemy. The punishment for that, if convicted, is death.
Bowe Bergdahl doesn’t need a cozy desk job; he needs to be punished for his crimes! And every day that he is allowed to work alongside the real heroes in our military is another opportunity for this terrorist sympathizer to do harm to this country.
Again, every American deserves a fair trial. But that doesn’t mean that every American has a right to be out on bail! Until proven innocent, Bowe Bergdahl must be viewed as a threat to this country and everyone else around him!
There isn’t a shred of evidence that suggests that Bergdahl is innocent. The only ones who have ever claimed that just happen to work in President Obama’s State Department.
The fact that Military investigators are stalling this case and that Bowe Bergdahl walks the streets a free man is a slap in the face to every soldier who served his or her country honorably and with distinction.
